Will of John Bitner

[2 January 1872]

I John Bitner of Union Township Snyder County Pennsylvania farmer do make and publish this my last will and testament, hereby revoking and making void all former wills by me at any time heretofore made; And first I direct that my body be decently interred, and that my funeral be conducted in a manner corresponding with my estate and situation in life. And to such worldly estate as it hath pleased God to entrust me with, I dispose of the same as follows:

First I direct that all my debts, and funeral expenses be paid as soon after my decease as possible, out of the first moneys that shall come into the hands of my executors, from any portion of my estate, real or personal; My personal effects shall be appraised by three disinterested persons, and my beloved wife shall select such articles as she may deem proper amounting to the sum of Three hundred dollars and the balance shall be sold by my hereinafter named executor at public sale.

Second I give and bequeath to my grand daughter Elmira daughter of George Bitner the sum of two hundred dollars to be paid to her by my executor as soon as she arrives at the age of twenty one years.
Third I give and bequeath unto my son George Bitner all my real estate of which I am possessed consisting of the farm on which I now live containing one hundred and twenty nine acres more or less situate in Union Township Snyder County Pennsylvania. For which he shall pay the sum of Eight thousand Dollars in manner following to wit.

One third of the sum of Eight thousand dollars shall remain in the farm as a dower for my beloved wife Anna Martha during her life time of which sum my son George Bitner shall her the annual interest during her natural life. After the decease of my wife this sum shall be equally divided among my children or legal heirs. The sum of Eight thousand dollars shall be equally divided among my five children viz. My daughter Elizabeth intermarried with Gotleib Schrey, my sons George Bitner, Casper Bitner, Christopher Bitner, Adam Bitner in manner following to wit: One year after my decease my son George Bitner shall pay unto my daughter Elizabeth the sum of three hundred dollars. The second year my son George Bitner shall reserve three hundred dollars for his share. The third year after my decease he shall pay my son Casper Bitner the sum of three hundred dollars. The fourth year after my decease he shall pay my son Christian Bitner the sum of Three hundred dollars. The fifth year after my decease my son George Bitner shall pay Three hundred dollars unto my son Adam Bitner. The sixth year after my decease he shall commence paying in the same order as directed above viz. with my daughter Elizabeth and so on until the youngest son Adam Bitner and in this same manner continuing until the whole amount due them is paid. The amount of Eight thousand dollars shall not be on interest nor any of the payments thereon.

I hereby constitute and appoint my son George Bitner to be my executor of this my Last Will and Testament hereby revoking all former wills by me at any time heretofore made, and do declare this to be my last Will and Testament. In witness whereof I the said John Bitner have to this my last will and testament, set my hand and seal January Second One thousand eight hundred and seventy two.

This writing contained in this sheet was signed and sealed by John Bitner and by him published and declared as and for his last will and testament in the presence of us, who have hereunto subscribed our names in his presence and in the presence of each other.

Will of Gottlob Schrey

In the name of God, Amen. I, Gottlob Schrey, of Union Township, Snyder County, Pennsylvania, being in good health of body and of sound and disposing memory, (praised be God for the same) and being desirous to settle my worldly affairs, while I have strength and capacity so to do, do make and publish this my last will and testament, hereby revoking and making void all former wills by me at any time heretofore made; And first and principally I commit my soul into the hands of my Creator who gave it, and my body to the earth, and as to such worldly estate wherewith it hath pleased God to intrust me, I dispose of the same as follows:

Item 1st I give and bequeath to my beloved wife, Elizabeth Schrey, all my household furniture, horse, harness, buggy, cattle, hogs, chickens and grain, that I may be possessed of, and in addition to this the privilege of remaining on the premises during her widowhood and receive the same shares from the farm as I am getting at the time of my decease. Should she, my wife, Elizabeth Schrey, choose to get married again, the aforesaid privileges shall be forfeited.

Item 2nd I give and bequeath to my son, Charles W. Schrey, my entire farm, the homestead, the following described real estate, situate in Union Township, Snyder County, Pennsylvania, Bounded on the North by lands of R. S. Aucker and J. W. Gaugler, East by land of heirs of Charles Hoover and a public road, South by lands of Martha J. Bitner and R. S. Aucker and Catharine Aucker, West by lands of James Rathfon and Henry Scholl, Containing one hundred thirty-nine acres more or less, with the appurtenances, to have and to hold the said messuage and tract of land above described, to him, his heirs and assigns forever. Except, that he, the said Charles W. Schrey, shall pay to my son, of my first wife, James W. Schrey the sum of Four hundred dollars ($400.00) as the said James W. Schrey's full share of legacy.

Item 3rd I direct that my hereinafter named executors shall collect all monies, collectable, due me or belonging to me, whenever due, from which sum or monies pay to my daughter Lizzie Schrey, Three hundred twenty-five ($325.00) dollars, the same amount, that I gave to my other children, Viz: Sallie, Katie and Charles W. Provided, the said Lizzie Schrey has not received the said sum before my decease, and pay my funeral expenses and all my just debts, and each executor shall receive twenty-five ($25.00) dollars for his services as executor, and my executors shall divide the remainder or residue equally, share and share alike, between my three daughters Viz: Sallie intermarried with James Rathfon Katie intermarried with Ammon S. Sechrist, and Lizzie Schrey.

And I do hereby constitute and appoint my son, Charles W. Schrey and my son-in-law Ammon S. Sechrist, executors of this my last will and testament. In witness whereof, I Gottlob Schrey, the Testator, have to this, my will, written on one sheet of paper, set my hand and seal, this 23rd day of March, A.D. 1898.

I, Casper Bittner, of the City of Akron, County of Summit and State of Ohio, being about 81 years of age and of sound and disposing mind and memory, do make and declare this my Last Will and Testament, hereby revoking and making null and void all other Last Wills and Testaments by me made heretofore.

FIRST - My will is that all my just debts and funeral expenses including the mortgage and accrued interest due Lillian Pike on my home, shall be first paid out of my estate as soon after my decease as shall be found convenient.

SECOND - I direct that all my property, both real and personal of whatsoever nature, of which I may die seized, shall be sold and the proceeds thereof, after the payment of all debts, shall be distributed as follows to wit: - First to my wife Mary Amanda Bittner an amount equivalent to her dower interest as provided by law and the balance equally among my children Clarence Bittner, Laura Bittner, Kate Schultz, Mason Bittner, William Bittner, George Bittner, Ferris Bittner, Mrs. Lillian Pike, and Walter Bittner, share and share alike. My piano I specifically give and bequeath to my grand-daughter Maxine Bittner.

THIRD - It is my wish that my son, William Bittner be appointed executor of this my last will and testament and I hereby authorize and empower him to settle and adjust all claims and demands in favor of or against my estate, and to sell, at private or public sale at such prices and upon such terms of credit or otherwise as he may deem best, the whole of my property and to execute, acknowledge and deliver deeds and other proper instruments of conveyance thereof to the purchaser or purchasers.

IN TESTIMONY WHEREOF, I have set my hand to this, my Last Will and Testament at Akron, Ohio this First day of June, A.D. 1922.

I, Martha Jane Bitner of Union township Snyder County Pa., being of sound mind do make this my last will & testament hereby making void all former wills by me heretofore made.

I direct that my herein named executors pay all my just debts & funeral expenses.

I give & bequeath to my 4 children Minnie B., Franklin O, Harry & Dollie May Bitner my homestead tract in Union Tp. Snyder Co. Pa. Containing 168a more or less bounded by lands of G. Schrey, John Wise, Reuben & Cath. Aucker & others to be used by them, & cannot sell this tract during their lives except one of said heirs can sell to any of said heirs said sale cannot be made until 5 years after their fathers (Christian Bitner's) death then they can sell or divide this tract as they may agree.

Said 4 heirs to permit my said husband Christian Bitner to have his home in the house we now live consisting of a bed room & its furniture, that is 1 bed, 2 Rockers, 2 chairs, table carpet, stove & pipe & coal & privilege to pass through the house into his room & said 4 heirs shall also maintaine with sufficient meat & drink which he desires the said Christian Bitner to come off the farm, during his sickness to be waited on by said Minnie & Dollie & if they can't then by said Frank & Harry.

I also give & bequeathe unto my said 4 heirs, the horses & cattle & farm implements which they can sell if they wish to pay the taxes & keep up repairs - No appraisment to be held of my estate.

I give & bequeathe to my daughter Jennie E. Brubaker Tract No 2 in said Union township containing 30a more or less bounded by lands of James Rathfon, Reuben Aucker & others for her use exclusive use during her natural life & after her death to revert to her children only. Said Jennie cannot incur any indebtedness on this tract. Said Jennie shall also pay to my said executors annually the sum of $20 during the natural life of Sophia Haas.

I give & bequeath to my said 4 heirs above numbered my house & lot in Selins Grove bounded by lots of Rishel & Stroub & authorize them to execute deed for same if sale be made.

Lastly I constitute & appoint Minnie B. Bitner and Franklin O. Bitner, Harry Bitner & Dollie May Bitner to be the executors of this my last will without bond.

The Petition of Minnie B. Bitner, Franklin O. Bitner, Harry Bitner & Dollie May Bitner respectfully showeth that the Executors named in the last Will and Testament of Martha Jane Bitner dated the 30th day of Dec. A. D. 1911

That said Martha Jane Bitner was a resident of Snyder County, State of Pennsylvania, and departed this life in Union Twp. in the County of Snyder and State of Penna. on the 18th day of Feb A. D. 1920 at 4:45 o'clock PM.

The said testatrix was possessed of personal property to the value of $2500 and of real estate (less encumbrance) to the value of $4,500 as near as can be ascertained, situated as follows: Located in Union Twp. House & Lot Selinsgrove.

Therefore, the said Executors respectfully apply for Probate of the said last Will and Testament, and for Letters Testamentary thereon.

Appointment of Transfer Inheritance Tax Appraisers

Whereas, Martha Jane Bitner, late of Union Township, in the County of Snyder and State of Pennsylvania, died on the 18th day of February 1920, seized and possessed of an estate subject to transfer inheritance tax under the laws of the Commonwealth of Pennsylvania.

Therefore, I, Edwin Charles, Register of Wills of the said County, do hereby appoint George R. Hendricks, of Selins Grove, Pa., Appraiser, to make a fair and conscionable appraisement of said estate, and to assess and fix the cash value of all annuities and life estates growing out of said estate.

Account of Harry Bitner

THE FIRST AND FINAL ACCOUNT OF HARRY BITNER, ONE OF THE EXECUTORS OF MARTHA JANE BITNER, LATE OF UNION TOWNSHIP, SNYDER COUNTY, PENNSYLVANIA, DECEASED .
DR.

 The said Harry Bitner received nothing as an executor, except as may be shown in the account of F. O. Bitner and Dolly Bitner, also prepared this day. And at present has no funds of the estate in his hands or possession.

The said Decedent died on February 18, 1920, Testate, leaving five children to survive her and Christian Bitner, her husband.

Under said Will Jennie Brubaker received a farm in full of her share of the estate. The remaining heirs received some cash and farm stock which is accounted for in the account of F. O. Bitner prepared this day. They also received a farm containing about 165 Acres of land, which the said four heirs still own. The said four heirs are, F. O. Bitner, Minnie Reinard, Harry Bitner, and Dolly Bitner, all sui juris.

Upon the death of said Decedent said farm was occupied and cultivated by Minnie Reinard, Harry Bitner and Dolly Bitner, during the year 1920. They raised during 1920 the following grains :-

443 Bushels of Wheat, 700 Bushels of corn in ears, 532 Bushels of oats, and 50 Bushels of potatoes, all of which crops were sold or used and after paying taxes on the farm the same was divided between the said occupiers of said farm.

During the year 1921, the said occupants remained on said farm and raised the following grains:-
oats---470 bushels, 381 bushels of wheat, 50 bushels of potatoes, and 546 bushels of corn in ears, all of which crops after deducting taxes and other necessary expenses, was used and divided between the said occupants of the farm, and F. O. Bitner.

During the year of 1922, the said occupants remained on said farm and raised the following crops:-
200 bushels of wheat, 300 bushels of oats, 90 bushels of rye, and 700 bushels of corn in ears, all of which after paying taxes and other necessary expenses, was used and divided between the occupants of said farm, and F. O. Bitner.

During the year of 1923, there was no tenant farmer or farmers on said farm, but the farmer occupants had put out some wheat which was harvested in 1923 and produced 202 bushels of wheat, which was sold and the money divided between Harry Bitner, Minnie Reinard, and Dolly Bitner, and F. O. Bitner.

During the same year Jacob Brubaker farmed some part of the farm and raised 640 bushels of corn in ears and 20 bushels of potatoes, said corn was divided between the said four heirs.
During the year of 1924, Charles Sholly, was the tenant farmer on said farm and raised the following crops:-

800 bushels of wheat, 800 bushels of oats, 1,600 bushels of corn in ears, and 520 bushels of potatoes, the tenant took one-half of the above crop and the other one-half was divided in kind or money between Minnie Reinard, F. O. Bitner, Harry Bitner and Dolly Bitner.

During the year of 1925, Charles Sholly, was the tenant farmer on the said farm and raised the following crops:-

775 Bushels of Wheat, 765 Bushels of Oats, 1,900 Bushels of corn in ears and 400 bushels of potatoes, this was the total yield, one-half of which went to the tenant and the other half was paid over in kind or money to Minnie Reinard, F. O. Bitner, Harry Bitner, and Dolly Bitner, who paid the taxes.

During the year of 1926, Harry Bitner, was the tenant farmer on the said farm and raised the following crops:-

800 Bushels of corn in ears, 737 Bushels of Oats, 180 Bushels of potatoes, this was the total yield for this year, one-half of which belonged to the tenant and the other one-half was divided between Minnie Reinard, F. O. Bitner, Harry Bitner, and Dolly Bitner, who paid the taxes on said farm.

During the year of 1927, Harry Bitner, was the tenant farmer on the said farm and raised the following crops:-

788 Bushels of Corn in ears, 821 Bushels of Oats, 332 Bushels of Wheat and 279 Bushels of potatoes, this was the gross yield for this year, one-half of which the tenant received and the other one-half was paid over in money or kind to Minnie Reinard, F. O. Bitner, Harry Bitner, and Dolly Bitner, who paid the taxes on said farm.

During the year of 1928, Harry Bitner, was the tenant farmer on the said farm and raised the following crops, which he can state at this time:-

342 Bushels of potatoes which were divided among the four heirs, less the tenant's one-half, 310 Bushels of Oats, 103 Bushels of Wheat, 210 Bushels of corn in ears, have been harvested and thrashed, but some oats and wheat and corn remain to be thrashed and husked, and when the same is done a division of said oats, wheat and corn will be made.
