Will of James Woodsides

 

          In the Name of God Amen. James Woodsides Considering the Uncertainty of this Mortal Life, and Being of Sound and Perfect mind and Memory Blessed be the Almighty God for the same Do Make and Publish this my last Will and Testament, In Manor and form Following

 

          First I give and Bequeath To My Beloved Wife the Back room in the house and liberty at the fire To go and Come from the Room, also A bed and Bed Cloths, also kitchen furniture Enughf to Suply her, also A cow In the stable of her Choseing, also if the orchard Bears she is to have Two Barrels ceder yearly, likewise she is to have one quarter of an Acre of flaxseed sown yearly, likewise she is to have Bread and flower and Meat and part of the stove in her room to Warm it During her live,

 

          Secondly I Bequeath unto My Eldest son Jonathan the lower Tract or Plantation Called the Deer lick, Containing about fifty acres without Dept or Demand Unto him and his heirs for Ever unto his Executors administrator or assigns

 

          Thirdly I Bequeath Unto My Daughter Mary and her heirs the sum of fifty Pounds To be paid Unto her After the Desease of her Mother yearly Ten Pounds Untill fifty Pounds Be paid

 

          Forthly I Bequeath Unto My son John and his heirs the tract or plantation where he now lives on Called the third gap, Containing one hundred Acres More or less he is also To have the waggon and Windmill, and John is To Give all above Mentioned To My wife out of the plantation, and if she not Being Contented To live with my son John in the Backroom, he is to give her Thirty Dollars, and let her live in the house he lives in now And she finds herself, Also after the Desease of his Mother he is To pay To his sister Mary and her heirs fifty Pounds, Ten Pounds yearly Untill fifty Be paid

 

          Lastly I Bequeath and Apoint My son John & Jacob Meck To Be Executors of this my Estate as to all the Rest Residue and Remainder of any personal Estate, goods and Chattles of what kind of Nature soever(?), To Aprais and Make sale thereof and To Divide it then among them, only My wife To have her Thirds out of it the first, and My Body to Be buryed In a Christian Like Manner at the Expense of my Estate and this To Be my Last will and Testament, hereby Revokeing all former wills By me made, In witness whereof I have hereunto set my hand and Seal this seventh Day of March In the year of our Lord one Thousand Seven hundred and ninty Six

          This 20th Day of December AD 1805 before me the subscriber Register for the probate of wills & granting Letters of Administration in & for the said County personally came Daniel Miller being one of the subscribing witnesses to the foregoing will & being duly sworn as the Law directs doth depose & say that he was present & saw & heard James Woodsides the Testator make his mark as above & acknowledges the said Instrument of writing to be his Last will & Testament & at the time of so doing he was of perfect sound mind & memory to the best of his Knowledge & Belief. same time Jacob Meck being Sworn doth depose & say that he was present at the Execution of the said Will & that he heard James Woodsides the Testator acknowledge said Instrument of writing as & for his Last Will & Testament.
